One of the most common questions that we hear from our clients is "will I go to jail or prison because of my DUI?" This is a serious, life-altering situation, so let's talk.

Whether you go to jail or prison for a DUI conviction depends on a number of things and the laws vary somewhat from state to state. But in general, issues that impact jail or prison time include:

  • Your prior criminal record
  • The judge on the case
  • Whether you reached a negotiated plea with the state attorney

In Florida, for a first-time misdemeanor DUI, you could be sentenced up to 6 months in jail. The jail sentence for a second DUI conviction depends on whether you were charged for your first DUI and other factors.

Jail time is much more likely after a second conviction, especially if the convictions fall close together. For some third convictions, fourth convictions, and other enhanced DUIs, like DUI manslaughter, your likelihood of being sentenced to prison is even greater.

What to Do Next

If you are convicted of a DUI and you are facing possible jail time, there are a number of important issues that you need to consider and address immediately.

  • You need to adjust your budget to allow for a decrease in your income, equivalent to 6 months earnings or more.
  • You also need to arrange for someone to manage your finances and pay your bills and of course, take care of your pets or children, if you got to jail or prison.

We understand that facing a DUI conviction and possible jail or prison time can be frightening and confusing. It is critical that you have sound legal counsel and guidance to represent you, protect your rights, and help you plan for contingencies.
